These Terms & Conditions (“Terms”) govern access to and use of SlashMedical.com and purchases made from Slash Medical through our Website, telephone, email, quotation, invoice, purchase order, wholesale account, distributor account, reseller account, private-label program, OEM program, or another sales channel operated by Slash Medical.

By accessing the Website, creating an account, submitting an order, approving a quotation or invoice, submitting a purchase order, approving artwork or product specifications, or purchasing, receiving, distributing, reselling, or using products supplied by Slash Medical, you acknowledge that you have read, understand, and agree to these Terms.

If you do not agree with these Terms, please do not use SlashMedical.com or purchase products from Slash Medical.

1. PRODUCTS AND PRODUCT INFORMATION

Slash Medical supplies drug and alcohol testing products, rapid screening devices, specimen-collection products, urine drug test cups, dip cards, test strips, oral-fluid devices, specimen cups, medical supplies, gloves, and related products.

Products sold by Slash Medical may have different:

  • Regulatory classifications
  • Intended uses
  • Specimen types
  • Drug-panel configurations
  • Cutoff concentrations
  • Certifications
  • Clearances
  • Labeling requirements
  • Restrictions

Depending upon the particular product, classifications or intended-use designations may include:

  • FDA Cleared
  • CLIA Waived
  • Professional Use
  • Employment & Insurance
  • Forensic Use Only
  • Over-the-Counter where specifically applicable
  • Other classifications identified by the manufacturer or applicable product labeling

Customers are responsible for reviewing the product description, packaging, Instructions for Use, package insert, regulatory designation, cutoff concentrations, specimen type, and other relevant documentation before purchasing or using a product.

The classification of one product must not be assumed to apply to another product merely because the products look similar, contain the same number of panels, or screen for similar analytes.

2. CUSTOMER RESPONSIBILITY

The customer is responsible for determining whether a particular product is appropriate and lawful for the customer’s:

  • Intended use
  • Testing program
  • Organization
  • Jurisdiction
  • End user
  • Specimen type
  • Regulatory requirements

The fact that a product is available for purchase on SlashMedical.com does not mean that the product may lawfully or appropriately be used for every purpose, by every person, organization, or jurisdiction.

Organizations performing workplace, forensic, correctional, court, insurance, clinical, federally regulated, professional, or other specialized testing are responsible for understanding and complying with applicable laws, regulations, policies, and testing-program requirements.

3. PRODUCT DESCRIPTIONS, PHOTOGRAPHS AND SPECIFICATIONS

Slash Medical makes reasonable commercial efforts to provide accurate information regarding:

  • Specimen types
  • Product specifications
  • Images
  • Regulatory classifications
  • Pricing
  • Inventory availability

Manufacturers may periodically modify:

  • Instructions
  • Other non-material product characteristics

Website photographs may therefore be representative and may not always display minor packaging, labeling, or manufacturing changes.

Customers requiring a specific:

4. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not constitute guaranteed acceptance by Slash Medical.

Slash Medical may accept, reject, limit, hold, or cancel an order for legitimate business reasons, including:

  • Product availability
  • Inventory limitations
  • Pricing errors
  • Website errors
  • Regulatory concerns
  • Suspected fraud
  • Payment issues
  • Credit-account issues
  • Shipping restrictions
  • Orders inconsistent with a product’s intended-use designation
  • Other commercially reasonable reasons

If Slash Medical declines or cancels an order after payment has been received and no amount is otherwise legitimately due, the applicable payment will be refunded.

5. PRICING AND ERRORS

Slash Medical makes reasonable efforts to maintain accurate pricing.

However, typographical, programming, calculation, inventory, or pricing errors may occasionally occur.

Slash Medical reserves the right to correct errors and, where appropriate, modify or cancel an affected order before shipment.

Website pricing may differ from pricing provided through:

  • Wholesale agreements
  • Distributor agreements
  • Government contracts
  • Private-label programs
  • OEM arrangements
  • Marketplaces
  • Telephone sales
  • Written quotations
  • Volume discounts
  • Pallet pricing
  • Truckload pricing

Prices are subject to change unless specifically fixed by an accepted written agreement.

6. PAYMENT

By placing an order, the customer authorizes Slash Medical and its authorized payment processors to charge the payment method provided for:

  • Merchandise
  • Taxes
  • Shipping
  • Freight
  • Handling
  • Other disclosed charges

Customers purchasing under approved credit terms must pay invoices according to the applicable invoice or written credit agreement.

Past-due accounts may be placed on credit hold.

To the extent permitted by applicable law, commercial customers may be responsible for reasonable collection expenses associated with undisputed delinquent balances.

7. TAXES

Customers are responsible for applicable:

  • Sales taxes
  • Use taxes
  • Transaction taxes
  • Import taxes
  • Similar governmental charges

unless Slash Medical has accepted a valid exemption certificate, resale certificate, or other legally sufficient documentation.

Customers claiming tax-exempt or reseller status are responsible for providing and maintaining accurate and valid documentation.

8. SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless Slash Medical specifically guarantees a delivery commitment in writing.

Slash Medical is not responsible for delays caused by shipping carriers or circumstances reasonably outside our control after an order has been properly tendered for shipment, except where otherwise required by applicable law.

Customers are responsible for providing complete and accurate shipping information.

Additional carrier charges resulting from circumstances such as:

  • Incorrect addresses
  • Address corrections
  • Refused deliveries
  • Redelivery
  • Storage
  • Residential delivery
  • Limited-access delivery
  • Lift-gate requirements
  • Inside delivery
  • Other special carrier services

may be charged to the customer where applicable.

9. INSPECTION OF SHIPMENTS

Customers should inspect shipments promptly following delivery.

Please notify Slash Medical promptly regarding:

  • Shipping damage
  • Missing merchandise
  • Incorrect merchandise
  • Quantity shortages
  • Product defects
  • Other shipment discrepancies

Claims involving damaged or allegedly defective merchandise should ordinarily be reported within 5 business days of delivery whenever reasonably possible.

Slash Medical may request:

  • Photographs
  • Original packaging
  • Lot numbers
  • Expiration dates
  • SKU information
  • Shipping documentation
  • Quantity affected
  • Description of the issue
  • Storage conditions
  • Other information reasonably necessary to investigate the claim

Customers should retain affected merchandise and packaging until the matter has been resolved.

10. 30-DAY RETURN POLICY

Eligible standard merchandise may be returned within 30 days of receipt, subject to the Slash Medical Return & Refund Policy and these Terms.

Eligible returned merchandise must generally be:

  • Unused
  • Unopened
  • Undamaged
  • Unaltered
  • Unexpired
  • In original packaging
  • In resalable condition

All original seals, packaging, instructions, accessories, and components must accompany the return.

Return authorization from Slash Medical may be required before merchandise is shipped back.

Receipt of returned merchandise does not automatically constitute acceptance of a return.

All returned merchandise is subject to inspection.

15% RESTOCKING FEE

Approved returns of correctly supplied standard merchandise are subject to a 15% restocking fee.

The restocking fee will be deducted from the amount otherwise eligible for refund.

SHIPPING AND FREIGHT ARE NON-REFUNDABLE

Original shipping, freight, handling, expedited-delivery, and similar transportation charges are generally non-refundable.

An exception may apply when the return resulted solely from a verified Slash Medical error or where otherwise required by applicable law.

Customers returning merchandise because it is no longer wanted or needed are responsible for return shipping.

Returns should be shipped using an insured and traceable method.

Slash Medical is not responsible for merchandise lost or damaged during customer-arranged return transportation.

REFUND CALCULATION

An approved standard return will ordinarily be calculated as:

MINUS 15% Restocking Fee

MINUS Non-Refundable Shipping/Freight

MINUS Other Applicable Charges

Refunds will generally be issued to the original payment method.

11. PRODUCTS SHIPPED IN ERROR

If Slash Medical ships merchandise different from what was ordered, please notify us promptly.

After verification, Slash Medical may provide:

  • Replacement merchandise
  • Return authorization
  • Account credit
  • Store credit
  • Refund

When a return is necessary solely because of a verified Slash Medical fulfillment error:

  • The 15% restocking fee will not apply; and
  • Authorized standard return-shipping costs will be covered by Slash Medical.

12. DEFECTIVE PRODUCTS

Customers who believe a product is defective should discontinue use of the affected merchandise and contact Slash Medical promptly.

We may request:

  • Product name
  • SKU
  • Lot number
  • Expiration date
  • Photographs
  • Quantity affected
  • Storage information
  • Testing procedure
  • Description of the problem

Customers should not destroy or discard merchandise involved in a product-quality complaint unless instructed to do so.

If a product is verified to have been defective when supplied, Slash Medical may provide an appropriate:

  • Replacement
  • Credit
  • Refund

The 15% restocking fee does not apply to merchandise verified to have been defective when supplied.

13. NON-RETURNABLE PRODUCTS

Unless otherwise required by applicable law or specifically approved in writing, non-returnable merchandise may include:

  • Opened products
  • Used products
  • Products with broken or removed seals
  • Expired merchandise
  • Products improperly stored after delivery
  • Products damaged after delivery
  • Products returned outside the applicable return period
  • Clearance items identified as final sale
  • Closeout merchandise identified as final sale
  • Customized products
  • Custom configurations
  • Special-order merchandise
  • Private-label merchandise
  • OEM merchandise
  • Customer-specific packaging
  • Customer-specific labels
  • Customer-branded products
  • Products manufactured or procured specifically for a customer

Because drug-testing, specimen-collection, diagnostic, and medical products may be affected by storage, contamination, temperature, packaging integrity, and handling, Slash Medical may refuse returns where product integrity or suitability for resale cannot reasonably be verified.

14. WHOLESALE, DISTRIBUTOR AND RESELLER ORDERS

Wholesale customers, distributors, resellers, dropship customers, medical suppliers, and other commercial customers are subject to these Terms unless a separate written agreement states otherwise.

Slash Medical actively provides wholesale and reseller programs.

Eligible non-custom wholesale merchandise may be returned under the applicable 30-day return policy and is generally subject to:

  • A 15% restocking fee
  • Non-refundable original shipping and freight

Truckload orders, container orders, pallet orders, production runs, unusually large-volume purchases, or specially negotiated transactions may contain different terms stated in a:

  • Quotation
  • Contract
  • Invoice
  • Purchase-order acknowledgment
  • Distributor agreement
  • Wholesale agreement
  • Other accepted written agreement

Specific accepted written terms take precedence over conflicting general provisions for the applicable transaction.

15. PRIVATE-LABEL, OEM AND CUSTOM PRODUCTS

Private-label, OEM, customer-branded, custom-configured, specially manufactured, and special-order merchandise is generally:

FINAL SALE AND NON-RETURNABLE.

Customers are responsible for carefully reviewing and approving all applicable:

  • Artwork
  • Logos
  • Product names
  • Spelling
  • Branding
  • Drug-panel configurations
  • Cutoff concentrations
  • Product specifications
  • Labels
  • Packaging
  • Quantities
  • Regulatory statements
  • Instructions
  • Proofs

Once specifications or artwork have been approved and manufacturing or procurement has begun, the order generally cannot be:

  • Canceled
  • Returned
  • Refunded
  • Exchanged

Customer approval constitutes authorization for Slash Medical and/or its manufacturing partners to manufacture, label, package, or procure merchandise according to the approved specifications.

16. ORDER CANCELLATIONS

Standard orders may be canceled before fulfillment only when approved by Slash Medical.

An order that has entered warehouse processing, fulfillment, or shipment may no longer be cancelable.

Private-label, custom, OEM, and special-order merchandise generally cannot be canceled once production or procurement has commenced.

17. INTERNATIONAL ORDERS

Unless otherwise approved in writing, international purchases may be final because of:

  • Customs requirements
  • Regulatory restrictions
  • Transportation requirements
  • Re-importation limitations
  • Product-integrity considerations

International customers are responsible for confirming that products ordered may lawfully be:

  • Imported
  • Possessed
  • Distributed
  • Resold
  • Used

within the applicable country or jurisdiction.

Customers are responsible for applicable:

  • Customs duties
  • Import taxes
  • Brokerage fees
  • Registrations
  • Licenses
  • Permits

unless otherwise agreed to in writing.

18. RAPID DRUG TESTS ARE SCREENING DEVICES

Unless the specific manufacturer’s labeling states otherwise, rapid drug-testing products provide screening results.

A result described as:

  • Preliminary positive
  • Presumptive positive
  • Non-negative
  • Reactive

should not automatically be considered a definitive laboratory-confirmed result.

Where confirmation is required by law, regulation, employer policy, court procedure, correctional program, professional practice, or other applicable requirements, an appropriate laboratory confirmation methodology should be used.

Customers remain responsible for their testing program, including where applicable:

  • Specimen collection
  • Chain-of-custody procedures
  • Laboratory confirmation
  • Medical Review Officer review
  • Recordkeeping
  • Confidentiality
  • Reporting
  • Result management

19. TEST PERFORMANCE AND TEST RESULTS

Drug-test performance and results can be affected by numerous factors, including:

  • Improper collection
  • Improper timing
  • Specimen adulteration
  • Storage
  • Temperature
  • Expiration
  • User error
  • Cross-reactivity
  • Certain medications
  • Cutoff concentrations
  • Specimen characteristics
  • Failure to follow instructions

Customers must follow the applicable manufacturer’s:

  • Instructions for Use
  • Package insert
  • Warnings
  • Timing requirements
  • Storage requirements
  • Result-interpretation requirements
  • Limitations

Slash Medical does not make medical, treatment, employment, legal, probation, parole, insurance, or similar decisions for customers.

The applicable employer, agency, healthcare professional, laboratory, Medical Review Officer, legal authority, or other responsible decision-maker remains responsible for such determinations.

20. FORENSIC USE ONLY AND EMPLOYMENT & INSURANCE PRODUCTS

Slash Medical offers products with different regulatory classifications and intended uses, including products currently identified on the site as Forensic Use Only.

Certain products or configurations may be labeled:

FORENSIC USE ONLY (FUO)

Other products may have labeling permitting certain:

EMPLOYMENT & INSURANCE (E&I)

applications.

Customers must review the classification and intended use applicable to each specific product before purchasing, distributing, reselling, advertising, or using it.

FORENSIC USE ONLY

Products labeled Forensic Use Only are intended for appropriate forensic drugs-of-abuse screening applications and should not be represented as FDA-cleared clinical diagnostic products when such clearance does not apply.

Depending upon the product and applicable requirements, forensic settings may include:

  • Law-enforcement agencies
  • Police departments
  • Court systems
  • Probation departments
  • Parole departments
  • Correctional facilities
  • Juvenile detention facilities
  • Jails
  • Prisons

FUO products are not intended to diagnose, treat, prevent, or monitor a disease, illness, medical condition, or substance-use disorder.

AT-HOME AND OTC USE

Unless a specific product is expressly cleared, authorized, and labeled for home or Over-the-Counter use, a Forensic Use Only product should not be marketed or represented as an OTC home diagnostic device.

Distributors and resellers are responsible for preserving each product’s intended-use designation.

EMPLOYMENT & INSURANCE

Certain products may possess intended-use designations permitting specific employment or insurance screening applications.

Depending upon the individual product, these may include certain:

  • Pre-employment testing
  • Workplace testing
  • Random testing
  • Reasonable-suspicion testing
  • Post-accident testing
  • Return-to-duty testing
  • Insurance-related screening

The regulatory designation and labeling of the particular product control.

FEDERALLY REGULATED TESTING

A product used for general Employment & Insurance testing should not automatically be assumed to satisfy requirements applicable to federally regulated testing programs.

Customers involved with programs regulated by or involving organizations such as:

  • U.S. Department of Transportation (DOT)
  • Substance Abuse and Mental Health Services Administration (SAMHSA)
  • U.S. Military
  • Other federal agencies

are responsible for complying with applicable requirements.

These requirements may involve:

  • Authorized specimen types
  • Collection procedures
  • Chain of custody
  • Laboratory confirmation
  • Medical Review Officer procedures
  • Certified laboratories
  • Reporting requirements

SPECIALTY ANALYTES

Depending upon the individual product and regulatory classification, Slash Medical may offer screening products for specialty or emerging analytes including:

  • Kratom
  • Synthetic Marijuana / K2 / Spice
  • EtG

The presence of a particular analyte does not automatically determine a product’s regulatory classification.

CUSTOMER ACKNOWLEDGEMENT

By purchasing, distributing, reselling, or using an FUO, Employment & Insurance, or otherwise restricted-use product, the customer accepts responsibility for determining the lawful and appropriate use of that product.

Customers, distributors, and resellers must not knowingly relabel, misrepresent, or advertise a product for a purpose inconsistent with its designated intended use.

21. NO MEDICAL, LEGAL OR REGULATORY ADVICE

Information provided by Slash Medical regarding:

  • Drug detection
  • Detection windows
  • Cutoff concentrations
  • Testing procedures
  • Regulatory classifications
  • Intended uses
  • Product operation

is provided for general product-information and educational purposes.

Such information does not constitute individualized:

  • Medical advice
  • Legal advice
  • Regulatory advice
  • Compliance advice

Customers should consult an appropriately qualified professional when such advice is necessary.

22. COMPLIANCE WITH LAW

Customers are responsible for ensuring that their:

  • Purchase
  • Possession
  • Storage
  • Advertising
  • Distribution
  • Resale
  • Testing program
  • Use of products

complies with applicable federal, state, and local requirements.

Drug-testing laws and procedures may vary significantly by jurisdiction and testing purpose.

23. RESELLERS AND DISTRIBUTORS

24. STORAGE AND HANDLING

After delivery, customers are responsible for appropriate:

  • Storage
  • Transportation
  • Handling
  • Inventory rotation

according to applicable manufacturer instructions.

Exposure to inappropriate:

  • Temperatures
  • Humidity
  • Moisture
  • Direct sunlight
  • Contamination
  • Other improper conditions

may adversely affect product performance.

Slash Medical is not responsible for product issues caused by improper storage, handling, transportation, or environmental exposure after delivery.

25. EXPIRATION DATES

Drug-testing and related products have expiration dates established by their manufacturers.

Unless Slash Medical expressly agreed in writing before purchase to provide a specific minimum remaining shelf life, receiving an otherwise compliant and unexpired product does not constitute a defect merely because the customer expected a later expiration date.

Customers purchasing large quantities are responsible for considering anticipated usage and inventory requirements before ordering.

26. WARRANTIES

Products may be subject to applicable express warranties provided by their manufacturers.

To the maximum extent permitted by applicable law, except for warranties expressly provided in writing, SlashMedical.com and products supplied through the Website are provided on an:

“AS IS” AND “AS AVAILABLE” BASIS.

To the extent permitted by law, Slash Medical disclaims implied warranties, including implied warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

Nothing in these Terms eliminates rights or warranties that cannot legally be excluded.

27. LIMITATION OF LIABILITY

These limitations do not apply where liability cannot legally be excluded or limited.

28. COMMERCIAL CUSTOMER INDEMNIFICATION

To the extent permitted by law, commercial customers, distributors, and resellers agree to indemnify and hold harmless Slash Medical and its applicable owners, affiliates, officers, employees, representatives, and agents against third-party claims arising from the customer’s:

  • Unauthorized product claims
  • Unauthorized advertising
  • Improper resale
  • Unlawful relabeling
  • Product use inconsistent with labeling
  • Improper storage or handling
  • Violation of applicable law

  • Material breach of these Terms

This provision does not apply to liability that cannot lawfully be disclaimed or shifted.

29. PAYMENT DISPUTES AND CHARGEBACKS

Customers who believe a billing, product, order, or delivery problem has occurred are encouraged to contact Slash Medical promptly so the matter can be reviewed.

A payment dispute or chargeback does not automatically eliminate amounts legitimately owed under an order or written agreement.

Slash Medical may provide relevant evidence to payment processors, banks, credit-card issuers, or financial institutions in connection with a payment dispute, including:

  • Customer communications
  • Tracking information
  • Proof of delivery

36. NO WAIVER
